Eagle Cottage Terms and Conditions for Eagle Cottage. Ferry Road., Horning

1. Contract
Any contract to hire Eagle Cottage listed in the brochure incorporates conditions below and is between Eagle Cottage and you as the hirer. The contract does not take effect until Eagle Cottage despatch written confirmation of your booking to you. The contract is made in England and is governed in all aspects by English Law.

2. Hire Terms
All hire terms are quoted in £ sterling per week, equipped and described unless otherwise stated. The prices of unsold holidays may be increased or decreased, and corrections made to errors in advertised prices at any time before your arrangements are confirmed. The price of your chosen holiday will be confirmed at the time of booking. As changes and errors occasionally occur, you must check all details at the time of booking. As soon as the booking is confirmed by Eagle Cottage the hire terms are guaranteed.

3. Extra Persons.
The number of persons indicated for Eagle Cottage must not be exceeded.

4. Pets No pets are allowed

5. Payment.
You must send the initial payment stated on your booking form. This payment comprises your booking deposit in part payment for the cost of your Cottage

6. Late Bookings.
If a booking is made less than 56 days before the holiday start date. Full payment must be sent with the booking form. It will be refunded if the booking is not confirmed. Last minute bookings made by telephone must be paid by cash. The issue of a confirmation being deemed to be acceptance of these conditions.

7. Balance Outstanding.
Once your booking is confirmed you are responsible for the whole of the hire terms. The balance of hire must be paid to Eagle Cottage, no later than 56 days before the hire starting date or as otherwise stated on the Booking Confirmation. No reminders are sent and if the balance is not paid by the due date Eagle Cottage reserve the right to cancel the booking and treat it in accordance with Condition 9.
In no circumstances are post dated cheques acceptable and Eagle Cottage reserve the right to recover the cost of any bank charges incurred in handling dishonoured cheques, direct debit payments and foreign currencies.

8. Alteration Fee.
If you wish to alter any of your holiday arrangements after your booking has been confirmed you must immediately notify us in writing and we will do our best to help. An alteration fee of £25 may be charged by Eagle Cottage for any revised invoicing required.

9.Cancellation.
If you cancel your booking you must immediately notify Eagle Cottage by telephone and in writing by Recorded Delivery to the relevant address, shown on your booking confirmation.
In all cases of cancellation the deposit is forfeited. Eagle Cottage will endeavour to re-let the Cottage on the same hire terms but unless such re let is obtained you will remain responsible for the payment of the full balance.

10. Non Arrival
If you do not arrive at the Cottage by midday on the day following your hire start date and you have not notified Eagle Cottage that you will be late they shall be entitled to place the Cottage for re-let forthwith. Under the foregoing circumstances and in accordance with Condition 9, if the Cottage is not re-let for only part of the period of hire, you are responsible for the remaining portion of the balance of hire.

11. Take over of Cottage
Unless otherwise stated in the brochure, the normal time for entering the Cottage is from 4pm on the hire start date and every effort will be made to release the Cottage as soon as possible after that time. If the Cottage operator is prevented by circumstances beyond his control from making the Cottage available and cannot provide a suitable alternative, he will refund all money paid by you but no further liability will be accepted. You should notify the Cottage operator of any deficiencies in equipment for the Cottage. Failure to do so may render you liable for payment in accordance with Condition 17. Any shortcomings later discovered should be notified to the Cottage owner so that they can be remedied for you. No claims can be considered after your holiday for shortcomings not so notified.

12. Vacating of Cottage
You must vacate the Cottage in a clean and tidy condition by 9-30 am on the final day of hire. The Cottage operator may make a charge if the Cottage is not returned in a clean and tidy condition ( a cleaning charge of £30 will be made).

13. Minors / Single Sex Groups
Bookings from persons aged under 30 years or of a single sex cannot he accepted.

14. Unsuitable Hirers
The Cottage operator reserves the right to decline to accept a booking or refuse to hand over a Cottage to any person or group where in the opinion of the owner they are not suitable for the person or any group member on the grounds of age, ill health, or any other reason. In such cases all sums paid shall be refunded in full and the contract shall be discharged without further liability on either party. The Cottage operator reserves the right to repossess the Cottage at any time where a serious disturbance or damage has occurred or in the opinion of the Cottage operator is likely to occur because of the unsuitability of the hirer due to age, ill health, disability, or any other reason. In such cases, the Cottage operator shall not be liable to make a refund of any portion of the hire terms paid.

15. Hirers Equipment.
You may not take into the Cottage, without the owners permission, BBQ’s, portable heaters of any type, lighting equipment or anything which may cause danger to the Cottage, its equipment or its occupants.

16. Injury or damage to you or your property.
The Cottage operator is not liable for death, personal injury, or loss or damage to you or your property, or any property belonging to or in the possession or the hirer or any member of the hirer's party (including any motor cars parked at the Cottage, or their contents) unless it is caused by the Cottage operator's negligence or wilful default.

17. Damage to the Cottage and its Equipment .
The Cottage is insured with the exception of wilful or criminal damage for which you are totally liable.You are responsible for it and for its contents and equipment. You are expected to take all reasonable care of it and to report and pay for any damage or equipment lost, damaged or stolen. All equipment, utensils, etc. must be returned in a clean condition at the end of the hire period.

18. Cottage Delays or Curtailment.
The Cottage is checked before the start of each hire and in the event of any mechanical failure the right is reserved to delay take-over until a repair has been corrected, it is unlikely that your Cottage will suffer a mechanical failure. If a failure of any kind should occur, you must report it to King Line immediately so that steps can be taken to repair it.

19. Modifications and Descriptions
Every effort has been made to ensure that the Cottage description contained in the brochure are correct, However the right is reserved to make modifications to Cottage specifications that are considered necessary in the light of operating requirements. Layout plans in the brochure are for general guidance and are not to scale.

20. Disputes.
Any dispute. difference or question which may at any time arise out of the contract or the subject- matter thereof shall be referred to a single arbitrator to be agreed upon between the parties (or failing agreement to be nominated by the Chartered Institute of Arbitrators on the application of either party) in accordance with the provisions of the Arbitration Act, I950. or any statutory modification or re-enactment thereof for the time being in force.

These conditions supersede all previous issues.
